Press Release of Intertainment AG

Tentative ruling on pending issues in Franchise lawsuit

Ismaning near Munich, 17 August, 2004 – The competent judge in the fraud case brought against US film producer Franchise Pictures and others by Intertainment AG, based in Ismaning (Munich), has informed the parties involved, as part of a tentative ruling on law and motion matters, of her provisional decisions concerning the pending issues of the case. These issues include, for example, whether Intertainment should be awarded interest on the already fixed damages claim amount of 77.1 million dollars. English-language film industry journals have already reported on the positive tentative ruling for Intertainment.

Intertainment would like to point out that tentative rulings are merely provisional decisions that are not yet legally binding and may still be changed by the judge. Intertainment must therefore in relation to this tentative ruling as well, maintain the information policy it has adopted throughout this lawsuit, and refrain from commenting on any speculation or possible decisions. As soon as the judge's final decision has been made concerning the pending issues referred to in the tentative ruling, Intertainment will issue a detailed statement on the matter as quickly as possible. Intertainment expects this decision soon.
